Although the world went crazy over Janet Jackson’s infamous Super Bowl “nip-slip,” aka wardrobe malfunction, an appeals panel said the Federal Communications Commission over-reacted, according to USA Today.
The three-judge panel from 3rd Circuit Court of Appeals in Philadelphia upheld its findings that the FCC was improper when it fined CBS $550,000 for Jackson’s overexposure.
Jackson was performing on stage with Justin Timberlake during halftime when he ripped off her bustier and her breast fell out.
The world caught a glimpse – for just over half a second – of Jackson’s breast, but her nipple was covered with a silver pastee.
Those who blinked – missed it – but thanks to the freeze frames and the instant replays, the image may be burned in the minds of Jackson’s male fans for an eternity.
The FCC argued that CBS should have been prepared for such “shock value” from artists. After all, Timberlake’s lyrics were “I bet I’ll have you naked by the end of this song.”
But the panel thinks that such a hefty fine was not fair.
